Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and FamCEO ("FamCEO," "we," "us," or "our") governing your use of the FamCEO service, including our website, dashboard, and text-messaging features (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and the parent or legal guardian of the family members you add, or otherwise legally authorized to register their mobile numbers and act on their behalf. By using the Service you represent that you meet these requirements. The account holder (the "Account Holder") is the adult who creates and controls the account.

2. What FamCEO does

FamCEO is a household coordination tool. Family members send text messages (SMS/MMS) to a phone number associated with your account; FamCEO organizes those messages into tasks — such as requests, chores, shopping items, meals, and events — in a dashboard for the Account Holder, and sends automated text replies such as acknowledgments and reminders. FamCEO is a convenience tool for organizing household communication. It is not a security, safety, medical, or emergency service.

3. Not for emergencies

FamCEO is not an emergency service and must never be relied upon in an emergency. Messages are processed automatically and may be delayed, missed, or misclassified. Do not use FamCEO to report or respond to medical emergencies, safety threats, or any situation requiring urgent attention. In an emergency, call 911 (or your local emergency number) or contact appropriate emergency services directly. You are responsible for making sure the members of your household understand this.

4. Your account

You are responsible for the information you provide, for maintaining the security of your login credentials, and for all activity that occurs under your account. Keep your password confidential and notify us promptly of any unauthorized use. You agree that the information you provide is accurate and that you will keep it up to date.

5. Adding family members and consent

When you register a family member's mobile number, you confirm that:

You must remove a member (and can request deletion of their data) if they no longer consent or should no longer receive messages.

6. Messaging terms

By using the Service you and your family members agree to receive recurring automated SMS/MMS messages related to your household's activity (acknowledgments, reminders, confirmations, and similar). Message frequency varies with your family's activity. Message and data rates may apply. A recipient can reply STOP at any time to unsubscribe and HELP for help. Carriers are not liable for delayed or undelivered messages. You are responsible for any charges your mobile carrier imposes.

7. Subscriptions, billing, and cancellation

Some features of the Service require a paid subscription.

If any part of the Service is offered free of charge (for example during a beta or pilot period), we may start, change, or stop charging for it with reasonable notice.

You retain ownership of the content your family sends through the Service (such as messages and photos). You grant us a limited license to use, process, store, and transmit that content solely to operate and provide the Service to you, as described in the Privacy Policy. You are responsible for the content your household submits and for ensuring you have the rights to submit it.

10. Our intellectual property

The Service, including its software, design, branding, and the FamCEO and FamBot names, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your household in accordance with these Terms. You may not copy, modify, or create derivative works of the Service except as permitted by law.

11. Third-party services

The Service relies on third parties (including Twilio, Anthropic, Supabase, Vercel, Resend, and Stripe). Your mobile carrier and these providers have their own terms, and we are not responsible for their acts or omissions. The Service may also reference or link to third-party content that we do not control.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT MESSAGES WILL ALWAYS BE DELIVERED, RECEIVED, OR CORRECTLY CLASSIFIED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMCEO AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold FamCEO harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party — including any claim that you registered a phone number without proper consent.

15. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends and we will handle your data as described in the Privacy Policy. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Chemung County, New York, and you consent to their jurisdiction, except where applicable law provides otherwise.
